WARRANTY POLICY
Thank you for choosing DIGISENSOR products. Products stated in this agreement are referred to ODM Products, and shall refer to both hardware and firmware delivered by Manufacturer i.e. DIGISENSOR CO., LTD. Finished products are products with hardware and firmware designed and manufactured by Manufacturer, and could not be modified by customers. Semi-finished products are products prepared for the final stage of manufacture.
1. Limited Warranty ConditionsManufacturer warranty covers only those defects which arise as a result of normal use of the product, and do not apply to any product: (i) which has been repaired or altered, (ii) which has not been maintained in accordance with any operating or handling instructions provided by Manufacturer or Manufacturer’s authorized distributors, (iii) which has been altered or damaged by accident; (iv) which has been subjected to unusual physical or electrical stress, misuse, abuse, power shortage, or negligence or (v) which has been used other than in accordance with the product operating and handling instructions.
2. Limited Warranty Coverage
2.1. Within a period of time identified below from the date of purchase, if Manufacturer receives direct notice of defect (from Manufacturer’s customers) in any product which is covered by Manufacturer's warranty, Manufacturer shall either repair or replace the defective product, at Manufacturer's option and cost. Manufacturer’s liability is limited to damages not to exceed the original purchase price of the product sold to Customer of the Manufacturer. Manufacturer does not warrant the sale of used or reconditioned firmware or hardware.
Manufacturer Product Duration of Limited Warranty is up to 01 year from the original date of ExWork delivery for semi-finished products, and up to 03 years from the original date of ExWork delivery for finished products. Manufacture shall remark semi or finished products as well as the warranty duration in the quotations and invoices provided to Customer.
2.2. For supporting firmware, Manufacturer's limited warranty applies only to a failure to execute programming instructions. Manufacturer does not warrant that the operation of any product will be interrupted or error free.
2.3. This liability does not cover faults caused by the Customer’s or a third party’s incorrect handling of the product. All and any modifications, changes or add-ons made to a product without explicit prior
consent by Manufacturer will void the warranty for that product. Since the product is ExWork, Manufacturer shall also not be responsible for any shipping damage(s) due to delivery and transportation.
3. Warranty ProcedureManufacturer shall have no obligation to repair or replace until the customer returns the defective product to Manufacturer’s customer service center according to the Warranty Procedure in below:
3.1. All products returned or rejected shall be accompanied by an RMA (return material authorization) number and a report issued by the Customer, and stating the reason for the return and/or rejection, with proof such as photos of the defect. An RMA number will be asked by customer and given by the manufacturer before returning the defective goods. End-users must send defective products to the authorized dealers.
3.2. All products returned or rejected shall be in original shape for throughout custom clearance and re-packed carefully similar to the original package.
3.3. If it is Manufacturer’s faults, Manufacturer shall absorb the cost transportation fees and/ or costs incurred due to the delivery of the above components. Forwarder will be assigned by manufacturer. If it is customer’s fault, customer shall bare all costs including door-to-door delivery, transportations, taxes and duties in Vietnam and Customer’s original destination, plus repairing charges.
4. Limitation of WarrantyNeither Manufacturer or its third party suppliers make any other warranty or condition of any kind whether expressed or implied, with respect to the Manufacturer products, and specifically disclaim the implied warranties or conditions of merchantability, satisfactory quality, and fitness for a particular purpose.
For certain products shall be used together with software and hardware not provided by Manufacturer, Manufacturer’s information concerning such Products’ capability, capacity and performance shall not constitute a commitment or guarantee of any kind when such results are dependent upon software and hardware not provided by Manufacturer.
5. Limitation of LiabilityCircumstances that may be designated as force majeure shall be considered as grounds for relief for the Manufacturer from the warranty coverage and conditions, provided that the circumstance at hand could not have been foreseen when the warranty statement was made.
6. Other Terms and ConditionsIf Customer wants Manufacturer to make additional change to firmware outside of the warranty conditions such as modification/update of the product features, this is object to additional charges including, but not limited to firmware update firmware programming (update firmware and reinstall program). This condition shall be applied during or after the warranty period is over.
After the warranty period, the service charge will be calculated according to the agreement of the parties.
